This policy describes the general YAOL (Your AD On Line) service policies of which our existing and potential customers should be aware. Those policies are set for one purpose only -- We want to serve you better!
Warranties and Limited Liability
YAOL services or products are provided "as is" without any warranty of any kind, either expressed or implied including, but not limited to, implied warranties of merchantable quality, merchantability or fitness for a particular purpose. YAOL does not warrant that its services will meet your requirements, that it will operate in combination with software and/or services which you select for use, that the operation of YAOL will be uninterrupted and error free, that any errors will be corrected and/or that YAOL will meet any particular criteria of performance or quality.
YAOL will not be responsible for any damage you suffer. This includes loss of data resulting from delays, non- deliveries or service interruptions caused by YAOL negligence, your error or omissions or any communications difficulties outside of YAOL control. Your use of Internet is at your own risk. You assume full responsibility and risk of loss from your downloading and/or use of the files or other material obtained either directly or indirectly from YAOL. You agree that in no event shall YAOL be liable for any damages, including without limitation, direct, indirect, incidental, special or consequential damages, or damages for loss of profits or revenue incurred by you or any third party, whether in an action in contract or tort, even if YAOL has been advised of the possibility of such damages. YAOL does not guarantee the privacy of any data, content or other materials transmitted by, to or through its computer and/or communications systems, or any part thereof, including, without limitation, YAOL back-up materials.
Account Use Policies
YAOL makes its WWW servers available to subscribers of its Web presence services, but does not necessarily endorse any of the items published through its servers.
As a account holder in YAOL, you agree to indemnify, defend and hold harmless YAOL for any damages, judgments or expenses and other liabilities resulting from any final determination that the data, information and/or content stored, received or transmitted, now or in the future, to, through or from, as the case may be, your YAOL Account infringes and trade-mark, trade secret, copyright, patent or third party intellectual property rights and from any damages, claims, suits or actions which may arise, now or in the future, as a result of your use of YAOL services.
We reserve the right to refuse to serve the web presence materials of any existing user making inappropriate or unreasonable use of YAOL services or an applicant whose planned web presence activities are deemed to have the potential of creating negative impact on YAOL abilities to serve its customers.
The appropriateness and reasonableness of use, and potential of negative impact to YAOL of customer's materials are matters which shall be determined in YAOL sole judgment.
The term "web presence materials" is defined as data of any form that can be delivered by YAOL web presence software and hardware resources, including but not limited to its web server software, hardware, and Internet link. Examples of inappropriate or unreasonable use: providing copyrighted materials without authorization providing obscene or offensive materials (e.g. porno materials) providing materials whose nature and/or volume compromises the ability of YAOL servers to serve other users' web presence materials, instances including but not limited to unreasonable consumption of disk space, Internet link bandwidth, CPU, and memory usage, as determined by YAOL web server maintenance staff providing materials that violate the commonly accepted etiquette of the Internet providing materials that are deemed by the government authorities as inappropriate or illegal. Any such government determinations will be binding on the user, not YAOL users notified of inappropriate or unreasonable usage who fail to correct the situation can lose their web service. YAOL reserves the right to monitor the use and all materials made available by its subscribers, for purposes of accessing the appropriateness and reasonableness of use and potential negative impact to YAOL of customer's materials.
If we have taken actions based on the information provided in the form and later on you request us to repeat the process based on some new information from you, we will charge you the same amount of service fee.
Performance Policies
Once you have opened a web presence account at YAOL, as long as the acceptable use policy is observed, you have full freedom as far as how to structure/update your web docs is concerned. You can name them any way you wish, revise them anytime you prefer, or place some of them in different subdirectories for example.
Users of YAOL web presence resources understand that YAOL does not own or control any networks other than its own internal network, nor is responsible for performance (or non-performance) within such networks. However, YAOL will work with its Internet connectivity authority to maximize its Internet link's performance for its customers.
Termination Policies

YAOL reserves the right to suspend or even to terminate your account without prior notice if we find that you violate this service policy, especially when the activities are deemed to have the potential of creating negative impact on YAOL business or abilities to serve its customers.
